{"id":13152,"date":"2019-07-18T06:59:25","date_gmt":"2019-07-18T06:59:25","guid":{"rendered":"https:\/\/www.iwacu-burundi.org\/englishnews\/?p=13152"},"modified":"2019-07-18T06:59:25","modified_gmt":"2019-07-18T06:59:25","slug":"mukaza-high-court-to-reopen-hearing-over-interbank-burundi-case","status":"publish","type":"post","link":"https:\/\/www.iwacu-burundi.org\/englishnews\/mukaza-high-court-to-reopen-hearing-over-interbank-burundi-case\/","title":{"rendered":"Mukaza High Court to reopen hearing over Interbank Burundi case"},"content":{"rendered":"<p><strong>In a verdict announced on July 15th, Mukaza High Court has decided to reopen the hearing about the case opposing the Government of Burundi and Interbank Burundi-IBB on \u201cillegal\u201d foreign currency transactions between the latter and Trust Merchant Bank-TMB.<\/strong><\/p>\n<div id=\"attachment_13103\" style=\"width: 542px\" class=\"wp-caption alignleft\"><img aria-describedby=\"caption-attachment-13103\" decoding=\"async\" loading=\"lazy\" class=\" wp-image-13103\" src=\"https:\/\/www.iwacu-burundi.org\/englishnews\/wp-content\/uploads\/2019\/07\/Interbank.jpg\" alt=\"\" width=\"532\" height=\"306\" srcset=\"https:\/\/www.iwacu-burundi.org\/englishnews\/wp-content\/uploads\/2019\/07\/Interbank.jpg 800w, https:\/\/www.iwacu-burundi.org\/englishnews\/wp-content\/uploads\/2019\/07\/Interbank-300x173.jpg 300w, https:\/\/www.iwacu-burundi.org\/englishnews\/wp-content\/uploads\/2019\/07\/Interbank-768x442.jpg 768w, https:\/\/www.iwacu-burundi.org\/englishnews\/wp-content\/uploads\/2019\/07\/Interbank-600x345.jpg 600w\" sizes=\"(max-width: 532px) 100vw, 532px\" \/><p id=\"caption-attachment-13103\" class=\"wp-caption-text\">Interbank Burundi is accused of having made an illegal foreign currency transaction with TMB<\/p><\/div>\n<p>According to Mukaza High Court, Trust Merchant Bank (TMB), a bank operating in the Democratic Republic of Congo has not yet taken part in the case as a civil party and has to give documents proving that it has often received foreign currencies from IBB since 2014.<\/p>\n<p>\u201cBurundi Central Bank-BRB must appear to give clarifications concerning the banking operations at the time of the inflow and outflow of foreign currency by the banks,\u201d says the court, adding that IBB must bring the documents given by BRB which authorized it to transfer foreign currency to a bank operating in the DRC.<\/p>\n<p>The BRB report of July 11th also approved the authenticity of IBB facts but that the breach resides in the content of the letter D1\/1697\/2015 regarding the withdrawal of cash, according to the court.<br \/>\nReferring to the recent hearings, \u201cthe Public Prosecutor\u2019s Office accuses Interbank Burundi of violating the exchange regulations,\u201d says the court adding that IBB categorically denies the facts against it. The bank also argues that it acts legally and presents different facts which justify the legality of the transaction it made.<\/p>\n<p>The case was taken to court by the Office of the Director of Public Prosecutions after two DRC citizens, namely Mbua Eboma C\u00e9sar, a TMB agent and his colleague were caught with $1, 5million at Gatumba boarder post on their way to the DRC.<br \/>\n<a href=\"https:\/\/www.iwacu-burundi.org\/englishnews\/government-accuses-interbank-burundi-of-conducting-illegal-transactions\/ During the judicial hearing of July 10th, Interbank Burundi accepted that the transaction was made and assumed that it was legal.\" target=\"_blank\" rel=\"noopener noreferrer\">Questioned, the two people said they withdrew that money from Interbank Burundi.<\/a><\/p>\n<p>Mukaza High Court adds that the two DRC citizens fell in an ambush of armed robbers at the border in which $190,000 was stolen and one person was killed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a verdict announced on July 15th, Mukaza High Court has decided to reopen the hearing about the case opposing the Government of Burundi and Interbank Burundi-IBB on \u201cillegal\u201d foreign currency transactions between the latter and Trust Merchant Bank-TMB.
